Property & Casualty Insurance: Manhattan Cooperative Building

The Board of a Manhattan co-op has hired Quadrino Schwartz on an $18 million insurance coverage matter. Substantial ongoing damage from environmental and other factors required extensive remediation and repairs to the structure. Quadrino Schwartz was selected as the law firm to consult with the Board to pursue all avenues of insurance coverage for the millions expended in labor and materials to fix the damage.

Liability Insurance & Third Party Bad Faith: Hospital System

A New York regional hospital system has hired Quadrino Schwartz in connection with an "excess jury verdict" matter in which the conduct of an insurer caused a loss to the hospital of more than $3 million. The liability insurer for the hospital refused to settle a medical malpractice lawsuit against the hospital, contending that the case was small and that a jury would not render a verdict in excess of the limit of the hospital's liability policy. After a multi-million dollar jury verdict was rendered against the hospital in excess of the coverage limit, Quadrino Schwartz was hired by the hospital to pursue the recovery of its loss from the liability insurer and the attorneys, both of whom severely underestimated the case and also failed to notify the hospital's excess liability insurer.

Health Insurance: Regional Oil Company

The firm is defending a home heating oil supply company in a lawsuit brought by a large health insurer to revoke a group insurance plan. The insurer contends that false statements were made in the application process when the plan was purchased. Quadrino Schwartz is mounting a vigorous counter attack, and several key battles in the litigation have already been won on behalf of the client.

Credit Life Insurance: Auto Dealership Group

A group of auto dealerships has hired Quadrino Schwartz to pursue unpaid commissions and earned premiums from a credit life insurer. The dealerships sold policies to their customers, in an arrangement with the life insurer, that would pay off auto loans or leases in the event of death or disability of the customer. The dealer group alleges that it is owed hundreds of thousands of dollars that remains unpaid.

Health Insurance: Chiropractic Office

Quadrino Schwartz has been brought in to handle an audit investigation by a national health insurer. The client has been contacted by the insurer, seeking billing and patient information. These audits often result in allegations by the health insurer that a refund of amounts allegedly "overpaid" to the medical practitioner must be returned to the health insurer. Quadrino Schwartz handles these audits and investigations in a manner that eliminates or reduces the medical practitioner's liability to the health insurer.

Auto Medical “No Fault” Insurance: Management Company

A management company for a radiology practice retained Quadrino Schwartz to defend the company in a lawsuit brought by a major national auto insurer. The case involves a challenge to the corporate structure of the practice. The insurer is pushing for a ruling to invalidate all of the billing and is seeking a refund of millions of dollars in paid claims and Quadrino Schwartz, on behalf of the client, is fighting to dismiss the case as an improper and legally unfounded claim.

There are hundreds of thousands of dollars at stake, and Quadrino Schwartz and the client are vigorously pursuing rulings requiring payment for all losses suffered in connection with the devastating fire.

A Manhattan law firm has hired Quadrino Schwartz to evaluate coverage under its professional liability insurance policy. A former client has sued for malpractice, and the insurer has disclaimed coverage contending that the acts that gave rise to the malpractice lawsuit pre-dated the purchase of the insurance policy. Quadrino Schwartz will investigate the circumstances and make a recommendation to the client as to the likelihood of success in bringing a declatory judgment action against for a legal defense and indemnification regarding the malpractice lawsuit.
