NEW YORK, Aug. 13, 2004 – Quadrino Schwartz obtains Court Order requiring First UNUM to disclose its illegal scheme to deny claims based upon financial budgets Kellner v. First UNUM, 03-Civ-5497 (Southern District, New York) In a resounding victory for a client, Quadrino Schwartz has obtained an order from a federal court in New York requiring First UNUM to disclose its illegal scheme to deny claims based upon financial budgets and targets. Witnesses to the illegal scheme have detailed these unlawful practices on the CBS News program “60 Minutes” and on NBC’s “Dateline” show. However, the secret databases, emails and other documents that reveal the full extent of the scheme have been a closely guarded secret by First UNUM and its parent company, UnumProvident. Until now, only a few documents have surfaced confirming the existence of UnumProvident’s unlawful program. The Order obtained by Quadrino Schwartz in Kellner v. First UNUM, 03-Civ-5497 (Southern District, New York) however, will now permit Quadrino Schwartz to get to the bottom of these illegal company practices.
