Acquittal in Undercover Narcotic “Buy and Bust” Operations Charges

Amy Marion obtained the acquittal of her client in an “impossible to win” case involving undercover narcotic “buy and bust” operations. In this particular case, both pre-recorded money and narcotics were recovered and used as evidence against the accused. Ms. Marion skillfully attacked the numerous law enforcement witnesses including the undercover officers who swore that Ms. Marion’s client both sold and possessed drugs and possessed pre-recorded buy money. Ms. Marion was successful in attacking the officers’ identification of her client, their testimony as to time, place, lighting conditions and modes of occurrence. The client had prior felony convictions that presented a risk of extreme prejudice against him if he testified. If convicted after trial, the client faced a maximum jail term of twenty-five years.
